Georgia Due Diligence Period: What Every Homebuyer Needs to Know

Many buyers think the hard part is over, but in reality, one of the most important phases of the homebuying process is just beginning. This stage is called the Due Diligence Period, and it gives buyers the opportunity to investigate the property before fully committing to the purchase.

What Is the Due Diligence Period?

The Due Diligence Period is a negotiated period of time written into the purchase and sale agreement that allows the buyer to thoroughly evaluate the property. Think of it as your opportunity to answer one important question: "Is this still the right home for me?"


During this time, buyers can investigate the home's condition, review important documents, obtain repair estimates, confirm financing details, and make sure there are no surprises before moving forward. Unlike many states, Georgia gives buyers significant flexibility during this period.

Buying a home is one of the largest financial decisions most people will ever make. Photos don't tell the whole story. Neither does a 30-minute showing. What Happens During Due Diligence?

✔ Review the Seller's Property Disclosure

Can a Buyer Cancel the Contract?

This is one of the biggest advantages of the Georgia Due Diligence Period. During the negotiated Due Diligence Period, the buyer generally has the unilateral right to terminate the purchase agreement for any reason—or no stated reason at all.

  • Maybe the inspection uncovered major issues.

  • Maybe repair estimates came back higher than expected.

  • Maybe the commute isn't what you imagined.

  • Or maybe you simply changed your mind.


As long as the buyer terminates the contract before the Due Diligence deadline and follows the terms of the agreement, they are generally entitled to the return of their earnest money.

Can the Seller Cancel the Contract?

While buyers generally have broad rights during the Due Diligence Period, sellers do not have the same unilateral right to walk away simply because they receive a better offer or change their mind. However, sellers may have rights under certain circumstances, such as when a buyer breaches the contract or fails to meet agreed-upon deadlines.


For example, a buyer who does not deliver earnest money on time or otherwise defaults under the agreement may create situations that affect the contract. This is one reason why meeting every contractual deadline is so important.


Does the Seller Have to Make Repairs?

No. A home inspection is designed to identify the property's condition—not require repairs. After reviewing the inspection report, buyers may:


  • Accept the home as-is

  • Request repairs

  • Request a credit toward closing costs

  • Request a price reduction

  • Negotiate another solution

  • Decide to terminate the contract during the Due Diligence Period


Everything is negotiable. The seller can agree, decline, or propose an alternative solution.


What Happens After the Home Inspection?

Many buyers think the inspection determines whether they buy the house. Not exactly.

Myth: The inspection automatically kills the deal.


Fact: Most inspection reports identify maintenance items. Very few homes receive a "perfect" report.


Myth: The seller has to repair everything.


Fact: Repairs are negotiated. Sellers are not automatically required to complete every requested repair.


Myth: Due Diligence is only about the inspection.


Fact: It's much broader. Buyers should also evaluate financing, insurance, HOA information, property condition, and whether the home truly fits their needs.
